POLICY
PREFACE
Thank you for choosing Durgmalhar Treks & Tours. We take all efforts to ensure that you have a delightful tour. To establish a clear understanding, we are sharing the below mentioned ‘Terms and Conditions’ of our Establishment. We request you to kindly go through the same and revert back in case of any queries prior to any tour booking / any dealing in any kind with any office bearers of Durgmalhar Treks & Tours at any location within India.
Once you book any tour with Durgmalhar Treks & Tours, it is understood that you are giving your unqualified consent to accept and abide by the ‘Terms and Conditions’. We request you to proceed with any transaction including booking of the tour with our office only after the acceptance of these ‘Terms and Conditions’.
TERMS & CONDITIONS
1. Primary:
1. The Guest, after the completion of inquiry process, proceeding with the booking or any other transaction w.r.t. any Group Tour / Customised bookings / Vehicle hire etc. i.e. offered by Durgmalhar Treks & Tours through its website / mobile application / branch office / any other medium, agrees to enter into a contract with Durgmalhar Treks & Tours. - A contract is said to have been executed between both the parties’ i.e Durgmalhar Treks & Tours and the Guest. Once a contract is executed, both the parties are bound by the ‘Terms and Conditions’ mentioned on Durgmalhar Treks & Tours website/ travel planner/ brochure/ booking form / Any other mode of communication etc.
2. On confirming the booking for the Tour offered by Durgmalhar Treks & Tours, the Guest agrees to provide his/her/travelling person’s information and consent for initiating the booking along with the payment of registration / non-refundable booking amount (which is declared with tour itinerary).
3. The confirmation of booking by way of any communication along with commercial transaction done by the Guest indicates that the Guest is interested in the tour and has read, understood and accepted all the ‘Terms and Conditions’ mentioned on Durgmalhar Treks & Tours website/ travel planner/ brochure / booking form as well as has agreed for the Itinerary declared which clearly mentions the inclusions and exclusions of the tour package offered by Durgmalhar Treks & Tours.
4. The terms and conditions will be obligatory on Durgmalhar Treks & Tours equally, whereby the responsibility to fulfil the assurance given to the Guest about providing all the services and facilities mentioned as per itinerary shall be to the fullest and any deviation of the same shall be compensated within the limit of the loss occurred, if any.
2. Physical and Mental Fitness:
1. When the guest books the tour or when someone else books the tour for him/ her, then it implies that the guest is physically and mentally fit to travel to that particular destination. It is very important for the guest to take care of his/ her health throughout the tour and carry the required medication if any with doctor’s prescription. Durgmalhar reserves the right to decline the booking or discontinue the guest from the tour if guest is found unfit to travel or his medical condition is causing inconvenience to fellow travellers. Any expenses due to health issues arising on tour shall be entirely borne by the guest and we shall not be held responsible in any manner whatsoever.
2. Guests must abide by the mandatory requirements for travel to the destination, such as Vaccination, RT-PCR tests, RAT, web check-in, self-declaration, e-pass formalities, health checks on arrival/ on tour etc. as per the state or country. These requirements or regulations are subject to change periodically. Any cost incurred for such requirements should be borne by the guests. It will be the sole responsibility of the guest to carry the certificate or test report with them and present it whenever asked for by the officials. Any State or Country or service provider such as Airline, Railway may decline the entry to a guest/s on medical grounds in such situation the consequences including all kinds of expenses will be borne by the guest.
3. Payment
1. To book any tour/ package/ service, guest must make the payment to Durgmalhar Treks & Tours by Cheque, NEFT, RTGS, IMPS, Payment app/ wallets like PhonePe, Gpay, or any UPI ID. All payments should be in the name ‘Durgmalhar Treks & Tours’ only. We support ‘Go Digital’ movement of India and request our guests to make digital payments.
4. Photo Identification:
1. For domestic tours in India, all guests must carry the photo identification in the form of Aadhar card, election ID card, PAN card, driving license and school / college ID card for students as officials may ask for photo identification at airports, rail stations certain sightseeing places, safari parks, border area locations etc. and every guest must produce the same on demand.
5. Accommodation on Tour
1. Accommodation provided on the tour depends on the category of the tour/ package. It may be in resorts, hotels, houseboats, tents, camps, dormitory, hostels, cruise, train, coach etc. The location of the accommodation generally depends on the tour program.
2. Suggested names of the hotels/ type of accommodation mentioned in the tour program are always subject to availability. Similar type of tours may be accommodated in different hotels/ type of accommodation depending on the capacity and availability at the destination.
3. Generally, the rooms are twin/double or single bedded and extra bed (if needed) is provided in the form of a mattress on the floor. Guests can upgrade the room to suite/ family room/ specific view room etc. subject to availability by paying an additional cost. If any guest wishes to have an additional room on tour, s/he can do so subject to availability by paying an additional cost.
6. Road Travel
1. For tours, air-conditioned/ air-cooled/ non air-conditioned vehicles are used as per the itinerary. The mode of transport for road journeys includes big coaches, mini coaches, tempo travellers, jeeps, cars or taxies depending on the type of the tour, itinerary, road conditions and the number of guest/s in the tour.
2. For certain tours we use small vehicles (Etios/ Dzire/ Innova or similar) for road travel. One car will accommodate 4-6 guests. Tour Manager will share one of the cars in the group on a rotational basis. These cars are meant to be used for road journey and sightseeing as per the tour itinerary and are not at the disposal of any individual or group of guests.
7. POLICY REGARDING CANCELLATION / NO SHOW
In the event of cancellation of travel arrangements due to any reasons–we must be notified of the same in writing. Cancellation charges will be effective from the time/date we receive your intimation in writing. Cancellation fees as below apply to the land packages and/or services. Non Refundable Booking Amount will not be refunded in any circumstances.
1. For any tour or package the services are booked well in advance. Therefore, any cancellation of the tour/ service booked will attract cancellation charges as specified at the time of booking. Your tour also includes third party service like airline, railway, transport, hotel, restaurant, caterer, sightseeing company etc., the Terms and Conditions and Cancellation Policy of such third party would be applicable in addition to Durgmalhar Treks & Tours Cancellation Policy and Terms and Conditions.
2. Once the booking is cancelled, it cannot be reinstated. Any reversal/ re-booking will be treated as fresh booking and additional charges may apply.
Following conditions must be noted: -
A. From booking date to 16 days prior to tour Non-Refundable amount shall be deducted and balance tour charges paid shall be refunded.
B. 15 to 08 days prior to Tour Start Date: Non-Refundable Booking Amount and any additional charges incurred for tour / travel/ railway/ air/ any other mode of transportation booking requirements, shall be deducted and balance tour charges paid shall be Refunded.
C. 07 days or Less prior to Tour Start Date: No Refund.
D. No Show – No Refund.
8. REFUNDS
In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 3 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.
9. GROUP HARMONY
Durgmalhar reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to, individuals who are intoxicated and/or under the influence of drugs leading to a negative experience for the remainder of the group. Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will necessarily be borne by the passenger. All unused services are non-refundable.
10. LIMITATION OF LIABILITY
The Tour Operator and its parents, subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for
A. Any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and
B. Any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control.
You waive any claim against the Tour Operator for any such loss, damage, injury, or death. In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of the Tour Operator or of the Third-Party Suppliers of any services which form part of the booking contract then the Tour Operator limits its liability, where applicable by all applicable international conventions.
11. TOUR Cancellation by DURGMALHAR TREKS AND TOURS
due to any sudden event not covered in any of the above mentioned clause and as so moto act, then there will be full refund of the tour cost / booking amount paid at the time of entering the booking contract by the guest.
Note: - All the rights to make any kind of changes in above terms and conditions are reserved in the hands of Durgmalhar Treks and Tours. However, it will be right of the Guest to have these Terms & Conditions made available to him/her prior to the booking or any dealing, as a base for his decision w.r.t. the confirmation in any legitimate form of communication.
